Property Dispute

  • My dad, 65, and my paternal granny are both postal govt. pensioners. My dad is the eldest of 4 siblings and when my paternal grandpa passed away, he took over his govt job at the age of 18. We are not in good terms with them since mum and uncle were not good towards mum.
  • Grandpa had bought a house in Dhubri, Assam before passing away where granny and the youngest uncle lived until recently before renting it out.
  • My dad paid off the entire loan amount till his 50s for this house while working in Shillong, Meghalaya. He also paid for renovations whenever he was asked for.
  • Dad doesn’t have enough savings and his retirement fund was also not that great.
  • In the inheritance papers, my dad along with his 3 siblings (2 brothers, 1 sister) and granny get an equal share in the house. Except the youngest uncle, all are married and well off.
  • Now the issue is, they are planning to sell the house and none of them want to give dad his share saying he had a govt job so he should not ask for more.
  • We currently live in a small rental house in Shillong as we don’t have anything of our own and we can’t afford a decent house with the money we have.
  • Every time dad had politely asked for his share, he was turned down by the youngest uncle in a rude manner. What can we do to deal with this situation legally and get a fast resolution?
